# Terms of Use (AGB)

This English translation is provided for convenience. The German version at tablemates.social/legal is the legally binding one; in case of any discrepancy, the German text prevails.

## 1. What TableMates is

TableMates ("the Platform") arranges small real-life meetups between people
with similar interests. The Platform suggests meetups, provides organization
tools (chat building blocks, tasks, reminders) and helps turn repeated
meetups into contacts. The provider is Marcus Maier ("we"); the full details
are given in the [Impressum (Legal Notice)](https://tablemates.social/legal/?d=impressum).

The Platform only arranges meetups. **We are not the organizer of the
meetups**, we promise neither that meetups nor that friendships will come
about, and we are not involved in what happens at a meetup.

## 2. Account

1. Use requires an account. You must be at least **18 years** old and
   provide truthful information.
2. An account is personal. Login credentials must be kept secret; you are
   responsible for activities carried out through your account to the extent
   that you are accountable for them.
3. You can delete your account at any time in the app (Profile → Delete your
   account). The details are governed by the Privacy Policy.

## 3. Conduct

1. Present yourself as the person you are. Fake profiles, harassment,
   discrimination, threats and passing on other people's contact details
   without permission are prohibited.
2. Other people's contact details (phone number, address) that were shared in
   the context of a meetup may only be used for that meetup and must not be
   passed on to third parties.
3. Anyone who commits to a meetup should show up or cancel in good time.
   Repeated unexcused absence may become visible in the reliability display
   and lead to measures under section 5.
4. The Platform must not be misused for commercial solicitation, advertising
   or automated access.
5. Images and other content: You only upload images to which you hold the
   rights and in which the persons depicted have agreed to appear. You grant
   TableMates the simple, non-exclusive right to store the image and to
   display it within the app in the way the visibility of the profile or
   meetup provides for. This right ends when you delete the image or your
   account. Sexual or violent images as well as images of minors without the
   consent of their legal guardians are prohibited. If an image violates your
   rights, report it via the report function or to contact@tablemates.social.

## 4. Meetups at your own risk

1. Meetups take place between the participants and at their own risk. We do
   not verify the identity or intentions of users beyond registration.
2. Be particularly careful before sharing private contact details or your
   address. Sharing is voluntary and, in practice, cannot be taken back once
   others have seen it.
3. Meetups in private homes ("At my place") are only open to people with
   whom the host is already connected via the Platform.

## 5. Moderation

1. Users can block people and report people or meetups.
2. In the event of violations of these Terms, we may remove content, cancel
   meetups, warn accounts, suspend them temporarily or close them
   permanently. The measure depends on the severity and repetition of the
   violation; where others are at risk, it may also be taken immediately.

## 6. Availability and changes

1. We operate the Platform with reasonable care but do not owe any particular
   level of availability. Maintenance, further development and disruptions
   may temporarily restrict the service.
2. We may further develop, change or discontinue features to the extent that
   this is reasonable for you.

## 7. Liability

1. We are liable without limitation for damage resulting from injury to
   life, body or health, as well as in cases of intent and gross negligence.
2. In cases of slight negligence, we are liable only for the breach of
   essential contractual obligations (obligations whose fulfilment is what
   makes the proper performance of the contract possible in the first place),
   limited to the foreseeable damage typical for this type of contract.
3. We are not liable for the conduct of other users or for events at
   meetups; section 7.1 remains unaffected.

## 8. Changes to these Terms

We may amend these Terms with effect for the future if the legal situation,
the features of the Platform or the technical conditions change. We will
inform you of material changes in the app at least 4 weeks before they take
effect.
If you object, the user relationship may be terminated.

## 9. Final provisions

1. German law applies. For consumers, mandatory consumer protection
   provisions of the state in which they reside remain unaffected.
2. Should individual provisions be invalid, the remainder remains valid.
